Should You Have A Buyers' Agent


How do you go about looking for a new home to purchase? Many start paying attention to for sale signs while cruising the city and neighborhoods that they are interested in and often call the Realtor or agent that is listed on a for sale sign. Some buyers know someone in the real estate business and ask them to provide more information on a particular house. If the house does not meet your needs there is a good chance you will continue utilizing the initial Realtor that you contacted. If for some reason you are not comfortable with that person you will make contact with another real estate professional and work with him/her in the same manner. This new person may be someone you know, someone else you contacted while driving around or you may look in the local newspaper or internet. You may also call a Realtor you worked with in the past.

All of the above agents work for the seller and their legal obligation is to the seller unless they become your Buyer’s Agent.   If you do not sign a Buyers’ Agency Agreement the professional you are using is the seller's’ agent and has the responsibility to look out for the best interest of the seller and not you. I have found that many buyers are not aware of this fact. Allow me to be your buyers’ agent and be legally bound to look out for your best interest and not that of the seller.

Under OCCUPATIONAL CODE Act 299 of 1980 of the state of Michigan here is the definition of a Buyer's Agent.

“…. under a buyer's agency agreement with the Realtor acts solely on behalf of the buyer. Buyer's agents and sub-agents will disclose to the buyer known information about the seller which may be used to benefit the buyer. Individual services may be waived by the buyer through execution of a limited service agreement. Only those services set forth in paragraph (2)(b), (c), or (d) above may be waived by execution of a limited service agreement.”

Just recently, I acted in the interests of the Buyer and negotiated an accepted purchase agreement in Beverly Hills, MI and in Grosse Pointe Woods, MI.
